Human rights defender Mr Oleg Volchek is being pursued by the Ministry of Taxes in Belarus in what is believed to be harassment as a result of his human rights activities. On 25 October 2012, Mr Oleg Volchek sent a letter to the head of the Inspection of the Ministry of Taxes and Dues for the Frunze district of the City of Minsk demanding clarification of the reasons for which he had been asked to submit a tax declaration for the last 10 years.

Minsk City Court’s Judicial Board turns down complaint by Hary Pahaniayla

Human rights defender Hary Pahaniayla appealed the judgment of Minsk Maskouski District Court. He asked to recognize actions by the Ministry of Justice and the Interior Ministry illegal, which led to his groundless inclusion in a data bank of “persons restricted to travel”.

Minsk Maskouski District Court failed to find out what kind of institution was to blame for entering the wrong data on the human rights defenders to the list of citizens who are temporarily restricted from leaving the country. The mistake was blamed on a technical failure, so the judge found it impossible to satisfy its claim.

Court turns down appeal of human rights defender Aleh Hulak

The head of the human rights organization “Belarusian Helsinki Committee” Aleh Hulak insisted that the court recognized as illegal the actions of the Ministry of Internal Affairs and the Ministry of Justice as a result of which he was prohibited to leave the country. Representatives of the ministries didn’t recognize the complaint and asked the court not to grant it.

Judge Alena Siamak evades consideration of appeal by Valiantsin Stefanovich

It has been three months now since Valiantsin Stefanovich, deputy chair of the Human Rights Center “Viasna”, urged Minsk Tsentralny District Court to appoint the date for the consideration of his appeal against illegal actions by the Ministry of Defense, who imposed foreign travel restrictions on the human rights defender.

On 26 June, the human rights defender phoned the Court’s administrative office just to learn that Judge Alena Siamak, who previously postponed the hearing owing “to pressing engagements”, would be on holiday until 13 July.

Court ignoring claims of travel banned Stefanovich for 3 months

The Minsk City Court refused to bring judge Syamak to responsibility on June 6, 2012.

Deputy head of Viasna human rights centre Valyantin Stefanovich went to court after he had found his name on the list of persons banned from leaving Belaus, but has not received a reply for three months, Viasna human rights centre reports.

Court chairman Uladzimir Putila told Valyantin Stefanovich the reason was the “workload of the judge”, so “the grounds to bring judge of the Tsentralny district court of Minsk Syamak over the arguments presented in the claim have not been found”.

“Viasna’s” property distrained, but they not expelled from office yet

Officers of the court of Pershamajski district of Minsk have distrained property of Human Rights Centre “Viasna” on May 30, 2012.

As one of the officers of the court informed, after taking inventory of the impounded property is made, the court is to decide which part of it belongs to Ales Bialiatski, Radio Svaboda informs.

None of the neighbours had agreed to become an attesting witness while the inventory of the property attached was made. The inventory had been made without witnesses for an hour until witnesses from the local housing management organisation appeared.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the  International Federation of Human (FIDH) and the World Organisation Against Torture (OMCT), deplores the recent arrest and sentencing of human rights defender Aleh Volchek.

 

On May 24, 2012, Mr. Aleh Volchek, Head of “Legal Aid to the Population”, an organisation that provided legal assistance until it was liquidated in 2003, was arrested by plain-clothed police officers who accused him of “swearing in public”. He was later brought to the Department of the Ministry of Internal Affairs of Tsentralniy district in Minsk, and sentenced on the same day to nine days’ administrative imprisonment by the Minsk Tsentralniy District Court, under...
